Terms of Service

These Terms of Service ("Terms") govern your use of mailtani ("we", "us", "our"), an email marketing platform accessible at mailtani.com. By accessing or using the Service, you agree to be bound by these Terms.

1. Service Provider

The Service is operated by:

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may not maintain more than one account.

3. Service Description

mailtani is an email marketing platform that connects to your own Amazon SES account. We provide the software platform; you provide the email sending infrastructure (Amazon SES credentials). Your emails are sent through your own AWS account — we do not send emails on your behalf as a sending provider.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk email (spam) in violation of applicable laws, including CAN-SPAM, GDPR, and similar regulations.
  • Send emails containing malware, phishing attempts, or fraudulent content.
  • Violate Amazon SES Acceptable Use Policy or AWS Terms of Service.
  • Harvest or collect email addresses without consent.
  • Impersonate any person or entity.
  • Engage in any activity that interferes with or disrupts the Service.

You are solely responsible for ensuring your email campaigns comply with all applicable laws and regulations, including obtaining proper consent from recipients and honouring unsubscribe requests.

5. Payment and Licensing

  • mailtani is offered as a one-time lifetime purchase, meaning access to the Service for as long as mailtani operates commercially.
  • Payment is processed by Polar.sh, who acts as the Merchant of Record. By completing a purchase, you also agree to Polar.sh's terms of service.
  • Your license grants you access to the Service and all future updates included in your purchased tier.
  • Pricing is subject to change for new customers; your purchased tier is locked in at the price paid.

5a. Free Trial

  • Starting a free trial requires a valid credit card. You will not be charged during the 14-day trial period.
  • Unless you cancel before the trial ends, your card will be automatically charged for the yearly subscription plan and billing will continue on a recurring annual basis until cancelled.
  • You may cancel your trial or subscription at any time from your account settings; cancellation before the trial ends prevents any charge.
  • Purchasing lifetime access at any point cancels any active yearly subscription.

6. Right of Withdrawal

In accordance with EU Directive 2011/83/EU, if you are a consumer, you have the right to withdraw from this contract within 14 days of purchase without giving any reason. However, since the Service is digital and delivery begins immediately upon purchase, by completing your purchase you expressly consent to immediate delivery and acknowledge that your right of withdrawal is thereby waived once the Service becomes accessible.

If you are purchasing as a business (which is the intended use of this Service), the right of withdrawal does not apply.

Refund requests are still accepted under our Refund Policy, regardless of the above.

7. Refund Policy

We offer a 14-day money-back guarantee. If you are not satisfied with the Service for any reason, contact us within 14 days of purchase for a full refund, no questions asked. See our Refund Policy for full details.

8. Your Data

  • You retain ownership of all data you upload to the Service (contacts, email content, etc.).
  • We do not sell, share, or use your contact lists or email content for any purpose other than providing the Service.
  • You may export or delete your data at any time.

9. Amazon SES Credentials

  • You provide your own Amazon SES API credentials to use the Service.
  • Your credentials are stored encrypted and are used solely to send emails on your behalf.
  • We are not responsible for any charges incurred on your AWS account.
  • You are responsible for managing your SES sending limits, reputation, and compliance.

10. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service.
  • We may perform scheduled maintenance with advance notice where possible.
  • We are not liable for downtime caused by factors outside our control (AWS outages, internet disruptions, etc.).

11. Intellectual Property

  • The Service, including its design, code, and documentation, is owned by mailtani and protected by intellectual property laws.
  • Your purchase grants you a personal, non-transferable license to use the Service, not ownership of the software.
  • You may not reverse-engineer, copy, or redistribute the Service.

12. Termination

  • You may cancel your account at any time by contacting us.
  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behaviour.
  • Upon termination, your data will be deleted within 30 days unless you request an export beforehand.

13. Limitation of Liability

To the maximum extent permitted by applicable law, mailtani shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Portuguese or EU law.

14. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free or uninterrupted.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Portugal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lisbon, Portugal.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
